Estimados Señor Presidente Donald J. Trump, Secretario de Estado Marco Rubio
y Compatriotas:
En éste 23 de enero,
fecha emblemática y gloriosa, en que los
venezolanos unidos en heroica jornada cívico militar puso fin a la dictadura
opresiva de Marcos Pérez Jiménez y abrazó la libertad y la democracia para
nuestra nación, la Alianza Nacional Constituyente Originaria (ANCO), organización de la sociedad civil venezolana,
comprometida con la restauración inmediata y plena de la libertad, la
democracia y el progreso nacional, se dirige a ustedes con el mayor respeto y
urgencia, en momentos decisivos para el futuro de Venezuela.
Agradecemos
la reciente, valiosa y decisiva
acción que usted y su Administración vienen desarrollando en nuestro país, lo que
representa un inédito hito histórico en la lucha por la democracia y contra el
totalitarismo en América Latina.
Venezuela continúa atrapada en una crisis institucional, política y socioeconómica
profunda, agravada por 27 años de devastación
delincuencial, humanitaria y económica impuesta, a pesar de los continuos
esfuerzos y actuaciones llevadas a cabo por su Administración.
Luego de la liberación
condicional de algunos presos políticos, que aún viven bajo amenaza constante,
más el temor persistente que impide el retorno masivo de más de 8 millones de
emigrantes, el país aún se encuentra bajo un gobierno interino designado por un
Tribunal Supremo de Justicia en
circunstancias de ilegitimidad, y en un
contexto de transición definido directamente desde Washington.
Las instituciones del Estado, sometidas por décadas de autoritarismo,
carecen de legitimidad democrática, perpetuando un sistema
opresivo que amenaza con mutar a nuevas formas de control totalitario si no se
actúa con la contundencia necesaria e inmediata.
En este contexto de ilegitimidad generalizada y crisis estructural, es
imperativo e inaplazable recurrir al poder originario del pueblo para
restablecer la soberanía popular, tal como lo consagra el artículo 5 de la
Constitución de la República Bolivariana de Venezuela (CRBV): “La soberanía reside intransferiblemente en
el pueblo”, quien la ejerce directamente o mediante sus representantes,
constituyendo la base de todo el ordenamiento jurídico.
La solución más idónea, adecuada y oportuna para
resolver esta crisis generalizada
que padece la nación se encuentra en nuestra propia Constitución, y es la convocatoria
inmediata de una Asamblea Nacional Constituyente Originaria, conforme a
su artículo 347 constitucional. Esta
Asamblea empodera al pueblo para revisar y cambiar los poderes públicos,
redactar una nueva Constitución y, en ejercicio de su poder originario y
supraconstitucional, iniciar un proceso legítimo de reinstitucionalización
total de la nación.
Su carácter plural, inclusivo y democrático garantiza
la participación efectiva de todos los sectores de la vida nacional, fomentando un verdadero
proceso de reconciliación nacional en justicia, sin exclusiones, revanchismos,
ni impunidad para los crímenes que se hayan cometido. Esta vía sienta las bases
sólidas para un futuro de progreso económico, modernidad institucional y
democracia plena concertada exclusivamente por la voluntad soberana del pueblo
venezolano.
Consideramos que la
renovación de los poderes públicos dentro del marco de una Asamblea Nacional
Constituyente que re institucionalice al país le dará a cualquier iniciativa aplicada
por su Administración en Venezuela, el piso jurídico necesario que requiere
cualquier factor dentro y fuera de los EEUU para generar crecimiento económico,
al regresar Venezuela al Estado de derecho.
En ANCO creemos que el plan de 3 fases
ideado por su Administración puede ser mejorado sustantivamente con la
inclusión de este proceso constitucional, luego de la denominada fase de
Estabilización, para que el pueblo venezolano pueda elegir en paz a sus representantes
en toda la geografía del país, para que luego la Asamblea Nacional
Constituyente electa, pueda designar un verdadero y legítimo Gobierno
de Transición Nacional y de Reinstitucionalización Democrática Representativo, en ejercicio y acatamiento a
los artículos 5, 62, 70, 326, 333, 347, 348 y 350 constitucionales, integrado
por venezolanos de trayectoria y experticia pública intachable, con
representación de la Fuerza Armada, y la participación de las fuerzas políticas
y sociales del país que deseen una solución democrática y electoral para
Venezuela.
En virtud de la importancia que
su gobierno ha dado al trabajo colaborativo con el gobierno interino, creemos
que el siguiente paso para la normalización económica y política del país pasa por la convocatoria constituyente
originaria inmediata, impulsada por la presidente en funciones, de
acuerdo al artículo 348 constitucional, por instancia del gobierno de los EEUU,
y antes de cualquier intento de elecciones superficiales
que no resuelven la raíz del problema nacional y obstaculizan innecesariamente,
señor presidente Trump, el propósito de su esperanzadora iniciativa. Los términos de esa
convocatoria (Bases Comiciales limpias y transparentes de la Constituyente, con
un Tribunal Electoral ad hoc independiente, supervisado
internacionalmente por EEUU y veedores nacionales e internacionales), deben ser
discutidos previamente por ustedes con el gobierno interino y la oposición
democrática.
En esta relación concertada con el gobierno interino,
dicho proceso supervisado en todas sus etapas por los EEUU, debe contar con todas las garantías absolutas
de transparencia, confiabilidad y verificación externa. Esta
exigencia no es opcional, es clave para estabilizar la República, desmantelar
cualquier vestigio de control autoritario y avanzar hacia una transformación
estructural profunda, en lugar de procesos electorales que han preservado en el
pasado el modelo centralista y/o autoritario vigente que ha destruido a
Venezuela.
Es crucial destacar que,
sin un Estado de derecho sólido, caracterizado
por independencia judicial, transparencia institucional y respeto irrestricto a
los Derechos Humanos, cualquier esfuerzo de recuperación económica estará
condenado al fracaso: los inversionistas internacionales y nacionales, demandan
garantías de estabilidad legal y previsibilidad para comprometer sus recursos.
Por
ende, debe
resolverse primero lo político mediante una reinstitucionalización radical que
desmonte las estructuras ilegítimas del país, para luego impulsar lo económico
con bases firmes. Una Asamblea Nacional Constituyente Originaria ofrece
adecuadamente en el momento actual este enfoque secuencial y estratégico al
priorizar el gran cambio político, administrativo y constitucional,
otorgando adicionalmente legitimidad
de origen y desempeño a un gobierno de transición imparcial
y representativo establecido
o designado por ella. Crea el
marco indispensable para un gobierno estable, representativo y alternativo, y
para una economía moderna, abierta, atractiva y sustentable, alineada con los
objetivos geopolíticos del mundo occidental de fomentar alianzas estables y
prósperas en América Latina, la inclusión exitosa de
Venezuela en el contexto internacional.
ANCO reitera
que convocar elecciones bajo el marco institucional actual ilegítimo no ofrece
el alcance transformador ni las garantías requeridas por el plan que su Administración
inició en Venezuela; y, porque no garantiza el desmontaje de normativas
ilegítimas, que hoy son un obstáculo para el despegue del país y la
reinstitucionalización urgente y necesaria para la recuperación del Estado de
derecho.
En contraste, la Asamblea Nacional Constituyente Originaria convocada
directamente por el pueblo sin la injerencia de órganos del Estado que la
normen o limiten, con participación universal de los venezolanos mayores de
edad dentro y fuera del país, inscritos o no en el Registro Electoral,
representa la vía constitucional suprema para acometer cambios y
contrarrestar la estrategia dilatoria del régimen que busca ganar tiempo,
posiblemente esperando un cambio en la situación política de los EEUU, para
frenar el proceso de liberación impulsado por su gobierno.
Implementar esta solución, a la mayor brevedad, antes de que finalice 2026,
es imperativo para capitalizar este momento histórico y asegurar un legado
duradero de libertad nacional y hemisférica. Esta iniciativa no solo rescata la
dignidad y futuro de Venezuela, sino que fortalece la posición de Estados
Unidos como baluarte de la democracia y estabilidad regional, conteniendo
influencias autoritarias y exógenas, y promoviendo la prosperidad compartida
que beneficia a ambos pueblos.
Respetuosamente les instamos a ustedes, Señor Presidente y Señor Secretario
de Estado, figuras claves en la política exterior de los EEUU, y aliados
históricos inquebrantables de la causa venezolana, a respaldar y promover
decidida y activamente la solución Constituyente Originaria, como prioridad
inmediata, emulando el legado
de coraje inquebrantable del espíritu libertario del 23 de enero de 1958, y al
esfuerzo solidario de la iniciativa del presidente Trump, junto al protagonismo
de la soberanía popular, como fórmula invencible, soberana, democrática, y
definitiva del renacer de una Venezuela soberana, libre, justa, democrática y prospera,
como aspiramos, y a bien han sabido anunciar al mundo.
ANCO se pone a la disposición para colaborar en su
articulación, garantizando transparencia, inclusión y apego fiel a los
principios constitucionales. Preciso es entregar al pueblo venezolano el
poder de decidir su destino por una nación libre, próspera, plural, federal y
democrática, ejemplo para América Latina y aliada estratégica de las mejores
causas libertarias de los Estados Unidos.

Dear President Donald
J. Trump, Secretary of State Marco Rubio, and Fellow Venezuelans:
On this emblematic
and glorious January 23rd, when Venezuelans, united in a heroic civic-military
struggle, put an end to the oppressive dictatorship of Marcos Pérez Jiménez and
embraced freedom and democracy for our nation, the National Alliance for
an Originative Constitution (ANCO), an organization from
Venezuelan civil society committed to the immediate and full restoration of
freedom, democracy, and national progress, addresses you with the utmost
respect and urgency, at this decisive moment for the future of Venezuela.
We appreciate the
recent, valuable, and decisive action that you and your Administration have
been taking in our country, which represents an unprecedented historical
milestone in the struggle for democracy and against totalitarianism in Latin
America.
Venezuela remains
trapped in a profound institutional, political, and socioeconomic crisis,
aggravated by 27 years of imposed criminal, humanitarian, and economic
devastation, despite the continuous efforts and actions undertaken by your
Administration.
Following the
conditional release of some political prisoners, who still live under constant
threat, and the persistent fear that prevents the mass return of more than 8
million emigrants, the country remains under an interim government appointed by
a Supreme Court of Justice under illegitimate circumstances, and within a
transitional context defined directly by Washington.
State institutions,
subjected to decades of authoritarianism, lack democratic legitimacy,
perpetuating an oppressive system that threatens to mutate into new forms of
totalitarian control if decisive and immediate action is not taken.
In this context of
widespread illegitimacy and structural crisis, it is imperative and urgent to
invoke the original power of the people to restore popular sovereignty, as
enshrined in Article 5 of the Constitution of the Bolivarian Republic of
Venezuela (CRBV): “Sovereignty resides inalienably in the people,”
who exercise it directly or through their representatives, constituting the
basis of the entire legal system.
The most suitable,
appropriate, and timely solution to resolve this widespread crisis afflicting
the nation is found within our own Constitution, which is the immediate convocation
of an Originative National Constituent Assembly, in accordance
with Article 347. This Assembly empowers the people to review and change the
public powers, draft a new Constitution, and, in the exercise of their original
and supraconstitutional power, initiate a legitimate process of total
reinstitutionalization of the nation.
Its pluralistic,
inclusive, and democratic nature guarantees the effective participation of all
sectors of national life, fostering a true process of national reconciliation
based on justice, without exclusions, reprisals, or impunity for crimes that
may have been committed. This path lays the solid foundation for a future of
economic progress, institutional modernization, and full democracy agreed upon
exclusively by the sovereign will of the Venezuelan people.
We believe that the
renewal of public powers within the framework of an Originative National
Constituent Assembly that reinstitutionalizes the country will give any
initiative implemented by your Administration in Venezuela the necessary legal
basis required by any party, both within and outside the United States, to
generate economic growth, as Venezuela returns to the rule of law.
At ANCO,
we believe that the three-phase plan devised by your administration could
benefit substantially by including this constitutional process, following the
denominated Stabilization phase. This would allow the Venezuelan people to
peacefully elect their representatives throughout the country, such that the
elected National Constituent Assembly can then appoint a truly legitimate Transitional
National Government and Representative Democratic Reinstitutionalization,
in accordance and compliance with Articles 5, 62, 70, 326, 333, 347, 348, and
350 of the Constitution. This government would be composed of Venezuelans with
impeccable track records and public expertise, with representation from the
Armed Forces, and the participation of the country's political and social
forces that desire a democratic and electoral solution for Venezuela.
Given the importance
your government has placed on collaborative work with the interim government,
we believe the next step toward the country's economic and political
normalization lies in the immediate convening of an original constituent
assembly promoted by the acting president, in accordance with Article
348 of the Constitution, at the behest of the U.S. government, and before any
attempt at the type of superficial elections that fail to address the root of
the national problem and unnecessarily hinder, President Trump, the purpose of
your hopeful initiative. The terms of this convening process (clean and
transparent electoral rules for the Constituent Assembly, with an independent
ad hoc Electoral Tribunal, internationally supervised by the U.S. and national
and international observers) must be discussed beforehand by you with the
interim government and the democratic opposition.
In this collaborative
relationship with the interim government, this process, supervised at all
stages by the U.S., must have absolute guarantees of transparency, reliability,
and external verification. This requirement is not optional; it is key to stabilizing
the Republic, dismantling any vestige of authoritarian control, and moving
toward a profound structural transformation, instead of the electoral processes
that have preserved the current centralist and/or authoritarian model that has
destroyed Venezuela.
It is crucial to
emphasize that without a solid rule of law, characterized by judicial
independence, institutional transparency, and unrestricted respect for human
rights, any effort at economic recovery will be doomed to failure:
international and national investors demand guarantees of legal stability and
predictability before committing their resources.
Therefore, the
political situation must be resolved first through a radical
reinstitutionalization that dismantles the country's illegitimate structures,
in order to then promote economic recovery on a firm foundation. An
Originative National Constituent Assembly adequately offers this sequential and
strategic approach at this time by prioritizing major political,
administrative, and constitutional change, while also granting
legitimacy of origin and performance to an impartial and representative
transitional government established or appointed by it. It creates the
indispensable framework for a stable, representative, and alternative
government, and for a modern, open, attractive, and sustainable economy,
aligned with the geopolitical objectives of the Western world to foster stable
and prosperous alliances in Latin America, with the successful inclusion of
Venezuela in the international context.
ANCO reiterates that calling elections under the
current illegitimate institutional framework does not offer the transformative
scope or the guarantees required by the plan that your Administration initiated
in Venezuela; and, because it does not guarantee the dismantling of
illegitimate regulations, which today are an obstacle to the country's
development and the urgent and necessary reinstitutionalization for the
recovery of the rule of law.
In contrast, the
Originative National Constituent Assembly, convened directly by the people
without interference from State bodies that might regulate or limit it, with
universal participation of all Venezuelans of legal age, both within and
outside the country, whether registered or not in the Electoral Role,
represents the supreme constitutional path to enact change and counter the
regime's delaying tactics; a strategy that seeks to buy time, possibly hoping
for a shift in the political situation in the United States, in order to halt
the liberation process promoted by your government.
Implementing this
solution as soon as possible, within 2026, is imperative in order to capitalize
on this historic moment for ensuring a lasting legacy of national and
hemispheric freedom. This initiative not only restores Venezuela's dignity and
future but also strengthens the United States' position as a bulwark of
democracy and regional stability, containing authoritarian and exogenous
influences and promoting shared prosperity that benefits both nations.
We respectfully urge
you, Mr. President and Mr. Secretary of State, key figures in U.S. foreign
policy and unwavering historical allies of the Venezuelan cause, to decisively
and actively support and promote the Originative Constituent Assembly solution as
an immediate priority. This should emulate the legacy of unyielding libertarian
courage of the invincible spirit of January 23, 1958, and the solidarity of
President Trump's initiative, along with the leading role of popular
sovereignty, as an invincible, sovereign, democratic and final formula for the
rebirth of a free, just, democratic, and prosperous Venezuela, as we aspire and
as you have so aptly proclaimed to the world.
ANCO offers its support in its implementation,
guaranteeing transparency, inclusion, and faithful adherence to constitutional
principles. It is essential to give the Venezuelan people the power to decide
their destiny as a free, prosperous, pluralistic, federal, and democratic
nation, an example for Latin America and a strategic ally of the best
libertarian causes in the United States.
